The Supreme Court has granted the Centre permission to review and reconcile Vodafone Idea’s pending adjusted gross revenue (AGR) dues of Rs 5,606 crore for FY 2016-17. A bench headed by Chief Justice B R Gavai and Justice K Vinod Chandran noted the government’s 49% equity stake in Vodafone Idea and its service to 20 crore subscribers. The court stated there was no reason to prevent the Centre from reconsidering the issue given these circumstances.

“Taking into consideration the status of the case now — the government has infused substantial equity into the company and that it will have direct bearing on 20 crore customers — we see no issue in the Union reconsidering the issue and taking appropriate steps,” the CJI said in the order.

Background of the Case

Vodafone Idea had challenged the fresh AGR demand, arguing that dues had been settled following the Supreme Court’s 2019 judgment. Senior advocate Mukul Rohatgi contended the new claim sought to reopen settled matters.

The company sought comprehensive reassessment of all dues up to FY 2016-17 in line with government guidelines issued in February 2020.

Government’s Stance

Solicitor General Tushar Mehta informed the court that the Centre was willing to examine Vodafone Idea’s representation, acknowledging the government’s partial ownership and public interest considerations.

He emphasized that the government holds 49% equity in Vodafone Idea, making the company’s financial stability a matter of national importance.

Understanding the AGR Dispute

The AGR dispute centers on how revenue is defined for calculating license fees and spectrum charges. The Supreme Court’s October 2019 ruling upheld the government’s broader definition, resulting in massive dues for telecom operators.

While telcos were given 10 years to clear dues, the court had previously ruled that AGR demands were final and shouldn’t be reassessed — a position Vodafone Idea has now successfully challenged.

Future Implications

The Supreme Court’s order maintains Vodafone Idea’s existing payment obligations but empowers the government to review dues based on policy considerations. This could lead to a more favorable resolution for the company, potentially helping it compete better against Reliance Jio and Bharti Airtel.
