Elon Musk’s Antitrust Lawsuit Against Apple and OpenAI Moves Forward

A US federal judge has allowed Elon Musk’s antitrust lawsuit against Apple and OpenAI to proceed, rejecting the tech giants’ bid to have the case dismissed.

Key Allegations in the Lawsuit

X Corp, owned by Elon Musk, filed the lawsuit in August 2024, accusing Apple and OpenAI of attempting to dominate smartphone and generative AI markets through their exclusive partnership.

The legal complaint alleges that Apple violated antitrust laws by granting ChatGPT exclusive integration through its Apple Intelligence platform on iPhones and other Apple devices.

Musk’s legal team argues this arrangement gives OpenAI access to millions of iPhone users while preventing competitors, including Musk’s own Grok chatbot, from securing similar integration opportunities.

Apple’s Defense and Judge’s Ruling

Apple has denied the antitrust allegations, maintaining in court that iPhone users can still access other chatbots through third-party apps and web browsers.

US District Judge Mark Pittman in Fort Worth, Texas, ruled that X Corp and xAI can proceed with their lawsuit. However, Judge Pittman clarified that his ruling “should not be seen as a judgment on the merits of X’s allegations,” noting that factual disputes would be examined at a later stage in the case.
