How the New Labour Codes Affect You

The new standardized definition of ‘wages’ now includes basic pay, dearness allowance, and retaining allowance. This definition will be used for calculating gratuity, pension, and social security benefits. Under the new rule, 50% of total remuneration will be considered for wage computation.

Universal Minimum Wages

All employees across organized and unorganized sectors now have a statutory right to minimum wages. The government will set a floor wage based on minimum living standards, with provisions for regional variations. No state can set minimum wages below this national floor level.

Expanded Wage Protection

Provisions ensuring timely payment and preventing unauthorized deductions will now apply to all employees, regardless of their salary level. Previously, this protection was limited to employees earning up to ₹24,000 per month.

Gratuity Reforms

Fixed-term employees become eligible for gratuity after just one year of continuous service, a significant reduction from the previous five-year requirement.

Overtime and Employment Terms

Accidents during travel between home and workplace are now considered employment-related and qualify for compensation. The codes also mandate gender equality, prohibiting discrimination based on gender or transgender identity in recruitment, wages, and employment conditions.

Work from home is now formally permitted in service sectors through mutual consent between employers and employees.

Migrant Worker Benefits

The definition of inter-state migrant workers has been expanded to include those employed through contractors or who migrate independently. Benefits include annual travel allowance to their native place and portability of PDS and social security benefits across states.
