Brazil’s former President Jair Bolsonaro faces a dramatic turn in his legal battle as authorities arrested him on Saturday over suspicions he was planning to avoid starting his 27-year prison sentence for leading a coup attempt.

Supreme Court Justice Alexandre de Moraes ordered the preemptive arrest after reporting that the far-right leader’s ankle monitor was violated early Saturday morning. The 70-year-old former president, who had been under house arrest, was deemed a flight risk and taken to federal police headquarters in Brasilia.

“(The) information shows the intent of the convict to break the ankle monitoring to assure his escape is successful, which would be made easier by the confusion that would be caused by a demonstration organized by his son,” de Moraes said.

Escape Concerns and International Dimensions

Justice de Moraes expressed serious concerns about Bolsonaro potentially fleeing to the United States embassy in Brasilia, noting the location was just a 15-minute drive from the former president’s residence. The judge also referenced other defendants in the coup case who had already left Brazil to avoid imprisonment.

“He is located about 13 kilometers (8 miles) away from where the United States of America embassy lies, in a distance that can be covered in a 15-minute drive,” said de Moraes, who has been sanctioned by the Trump administration.

Brazilian federal police had previously discovered messages in August linking Bolsonaro to a political asylum request to Argentina, where his ally Javier Milei serves as president.

Legal Proceedings and Family Involvement

The Supreme Court panel handling Bolsonaro’s case will vote on Justice de Moraes’ arrest order in an extraordinary session on Monday. The same panel had convicted him to jail by a 4-1 vote in September.

De Moraes specifically mentioned a video posted by Senator Flávio Bolsonaro, one of the former president’s sons, that encouraged supporters to protest outside his father’s residence. The judge described this as an attempt to “create chaos and conflict” in the country.

“Brazil’s democracy has reached sufficient maturity to steer away and prosecute pathetic illegal initiatives to defend the criminal organization that is responsible for a coup d’etat attempt in Brazil,” he added.

Coup Conviction Details

Bolsonaro and several allies were convicted for attempting to overthrow Brazil’s democracy following his 2022 election defeat to President Luiz Inácio Lula da Silva. Prosecutors revealed the coup plot included plans to assassinate Lula, Vice President Geraldo Alckmin, and Justice de Moraes himself.

The former president was found guilty of leading an armed criminal organization and attempting the violent abolition of democratic rule. He continues to deny all wrongdoing.

Allies Rally in Defense

Bolsonaro’s supporters immediately condemned the arrest. Fabio Wajngarten, his former press adviser and lawyer, called it “a terrible stain on the institutions” and claimed the ankle monitor was functioning normally hours after the alleged violation.

“How could something that was broken, violated, be functioning normally nine hours later?” he wrote.

Sóstenes Cavalcante, Bolsonaro’s party whip in the lower house, accused de Moraes of showing “psychopathy at the highest level” and promised an appropriate response.

Former first lady Michelle Bolsonaro vowed that supporters “will not give up on our nation,” expressing faith in “God’s justice” over human justice.

Political Implications for 2026 Elections

Political analysts suggest the arrest will significantly impact next year’s presidential election, where Lula seeks reelection and Bolsonaro remains barred from running.

“They had the idea of turning the 2026 election into a referendum on Bolsonaro. And for that to happen they needed actions, they needed to build an optics of Bolsonaro as a martyr and an impactful popular leader,” political analyst Creomar de Souza told the AP.

The arrest represents a dramatic escalation in the legal proceedings against the former president, coming just days before he was scheduled to begin serving his extensive prison sentence.
