India’s New IT Rules: Senior Officers Must Now Authorize Content Removal
The Ministry of Electronics and Information Technology (MeitY) has amended the IT Rules, 2021, introducing stricter protocols for removing unlawful online content. The updated rules mandate senior-level authorization and monthly reviews to ensure transparency and accountability.
Key Changes in Content Removal Framework
The amendments to Rule 3(1)(d) establish additional safeguards requiring content removal actions to be proportionate and accountable. These changes will take effect from November 1, 2025.
Senior-Level Authorization Mandatory
Content removal requests can now only be issued by:
- Officers not below Joint Secretary rank (or equivalent)
- Directors or equivalent officers where such rank isn’t appointed
- Specially authorized DIG-rank officers for police authorities
Stricter Documentation Requirements
Every removal intimation must clearly specify:
- The legal basis and statutory provision
- Nature of the unlawful act
- Specific URL or electronic location of content
This replaces broad ‘notifications’ with ‘reasoned intimations’ aligning with the ‘actual knowledge’ requirement under Section 79(3)(b) of the IT Act.
Monthly Review Mechanism
All content removal intimations will undergo monthly review by an officer not below Secretary rank of the Appropriate Government, ensuring continuous oversight.
The amendments aim to balance constitutional rights with regulatory powers, preventing arbitrary restrictions while maintaining effective enforcement.
