More trouble for Shami? SC notice issued after wife seeks case transfer to Delhi

The Supreme Court has issued a notice to India fast bowler Mohammed Shami following a petition filed by his wife, Hasin Jahan, seeking the transfer of their ongoing domestic violence and alimony case from Kolkata to Delhi.

A bench comprising Justices Manoj Mishra and Ujjal Bhuyan issued the notice, directing Shami and the West Bengal government to respond to Jahan’s plea. The case, which has been proceeding in Kolkata, could now be shifted to the national capital if the court accepts Jahan’s arguments.

In her petition, Jahan cited the reason for the relocation to Delhi to ensure better educational opportunities for their daughter and, as a result, will be unable to attend court hearings in West Bengal.

Jahan further argued that Shami, being a professional cricketer, travels extensively across the country for matches and training commitments. She contended that he possesses sufficient resources and means to fight the case in Delhi without facing any logistical challenges.

Additionally, Jahan pointed out that her family resides in Uttar Pradesh, which is geographically closer to Delhi than Kolkata. This proximity, she argued, would make it easier for her to manage court appearances if the case were transferred to the capital.

This development comes just months after Jahan approached the Supreme Court with another petition seeking a substantial increase in the alimony amount. She had requested that the monthly alimony for herself and her daughter be raised from Rs 4 lakh to Rs 10 lakh.

The petition for case transfer represents the latest development in the ongoing legal proceedings between the cricketer and his wife. The domestic violence and alimony case has been a matter of legal dispute, with both parties engaged in court proceedings.

Shami, who is currently representing Bengal in domestic cricket and remains a key figure in India’s bowling attack, has not yet responded publicly to the latest notice. The Supreme Court will now examine whether the reasons cited by Jahan are sufficient to warrant a transfer of the case, considering the convenience of both parties.

The court is expected to hear detailed arguments from both sides before arriving at a decision on whether to allow the transfer of proceedings from Kolkata to Delhi.
