Supreme Court Permits Government to Address Vodafone Idea’s AGR Dues
The Supreme Court has allowed the government to directly address Vodafone Idea’s adjusted gross revenue (AGR) dues without judicial intervention, providing significant relief to the struggling telecom operator. The court recognized this as a policy matter, noting the government’s substantial 49% stake in the company and the need to protect 20 crore consumers.

Court’s Rationale
The bench of Chief Justice B.R. Gavai and Justice K. Vinod Chandran observed that with the government holding substantial equity in Vodafone Idea and the issue affecting 20 crore consumers, the matter falls within the government’s policy domain. The court disposed of petitions while allowing the Union government to take appropriate measures.
“Taking into consideration the change in circumstances that now the government itself has a substantial equity in the petitioner company, and further that the issue involved is likely to have a direct bearing on the interest of 20 crore consumers, this is a matter within the policy domain of the Union,” the court stated.
DoT’s Additional Demand
The Department of Telecommunications has sought an additional ₹9,450 crore in AGR dues from Vodafone Idea, comprising:
- ₹2,774 crore from Idea Group and post-merger Vodafone Idea
- ₹6,675 crore from pre-merger Vodafone Group
This comes despite the Supreme Court’s 2020 order that locked AGR dues until 2016-17 and prohibited reassessment.
Vodafone Idea’s Position
The telecom operator argues that since the disputed components of AGR dues haven’t been finalized, it cannot be considered in default. The company seeks waiver of penalties and interest, stating that both parties agree the amounts need reconciliation and correction.
“Till the principal amount payable is not crystallized and finalized, it cannot be said that the petitioner is in default requiring payment of penalty,” Vodafone Idea stated in its petition.
Survival at Stake
Vodafone Idea faces existential challenges with:
- Existing AGR dues of approximately ₹83,400 crore
- Annual payments of ₹18,000 crore starting March
- Total liabilities estimated around ₹2 trillion including penalties
- 198 million subscribers and 18,000 employees at risk
The company has warned that without resolution, its survival and thousands of livelihoods are threatened. Former CEO Akshaya Moondra emphasized that early AGR resolution is crucial for securing bank funding.
